By accessing or using SpinAWheel.app (the "Site"), you agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree with any portion of these Terms, you must not use the Site.

These Terms constitute a legally binding agreement between you and SpinAWheel.app. Your continued use of the Site constitutes acceptance of these Terms and any modifications thereto.

3. Purpose & Disclaimer of Randomness

SpinAWheel.app is designed for entertainment, classroom, and other casual uses only. While every spin selects a winner using a fair pseudo-random algorithm (Math.random()), it is not suitable for high-stakes gambling, lotteries, raffles, or any other activity where legally enforceable randomness or certified fairness is required. You acknowledge that the Site’s randomness is not certified and accept all associated risks.

4. Disclaimers and Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPINAWHEEL.APP, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SITE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

6. Intellectual Property Rights

All content, graphics, logos, software, and other materials on the Site, including but not limited to text, images, audio, video, and code, are the property of SpinAWheel.app or its licensors and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site without prior written permission.

The "SpinAWheel" name and logo are trademarks of SpinAWheel.app. All other trademarks, service marks, and trade names used on the Site are the property of their respective owners.

7. User Content and License

By submitting text or other materials to the Site, you grant SpinAWheel.app a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content solely for the purpose of operating and improving the Site. You represent and warrant that you have all necessary rights to grant this license and that your content does not infringe upon the rights of any third party.

You retain ownership of any intellectual property rights that you hold in your content. You are responsible for ensuring that your content does not violate any applicable laws or regulations.

9. Termination and Survival

Upon termination, your right to use the Site will cease immediately. The provisions of these Terms which by their nature should survive termination shall survive termination, including but not limited to Sections 5 (Limitation of Liability), 6 (Intellectual Property Rights), and 7 (User Content and License).

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

You agree to resolve any disputes through binding arbitration or small claims court, rather than in a court of general jurisdiction, to the extent permitted by applicable law.

12. Severability and Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Entire Agreement

These Terms constitute the entire agreement between you and SpinAWheel.app regarding the use of the Site and supersede all prior agreements and understandings, whether written or oral.
